Terms of Use for GlobalConnect Developer Portal
General
The GlobalConnect Developer Portal, is provided to you by GlobalConnect AS ("GlobalConnect"). The Developer Portal provides you access to, documentation and other relevant materials to be used for consuming GlobalConnect Application Programming Interfaces (“APIs”).
Your access to and use of the GlobalConnect Developer Portal, are subject to the following Terms of Use (“Terms”). Additional terms and registration requirements may apply to specific APIs, which can be found in the API documentation. If usage terms specified here conflicts with usage terms for a specific API, the terms for the API supersedes these terms.
By accessing and using the GlobalConnect Developer Portal, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Use of the GlobalConnect Developer Portal
You must comply with and act in accordance with all instructions, documentation and other requirements as stated and/or made available by GlobalConnect in connection with the GlobalConnect Developer Portal, including APIs. You must comply with all legal requirements and refrain from creating content that is unlawful or otherwise objectionable, or that may harm GlobalConnect. You shall not:
- Distribute, transmit, modify, copy, display, lease, sell, publish, license, create derivative works from or use any content on the GlobalConnect Developer Portal for any other purpose than using the GlobalConnect Developer Portal in accordance with these Terms;
- Perform activities which hinder or prevent others from using the GlobalConnect Developer Portal;
- Negatively affect the operation and security of, or attempt unauthorized access to GlobalConnect’s services or systems;
- Reverse engineer any software, code or test data on the GlobalConnect Developer Portal or introduce any harmful software on the GlobalConnect Developer Portal;
- Use the GlobalConnect Developer Portal for scalability tests; and
- Use/send production or other sensitive data when performing testing activities based on information from the GlobalConnect Developer Portal.
Intellectual property rights
The GlobalConnect Developer Portal, including APIs made available on or through it are the property of GlobalConnect and/or its licensors and protected by applicable intellectual property laws. All rights in the GlobalConnect Developer Portal, including APIs, are owned by GlobalConnect or its licensors. GlobalConnect grants you a limited, non-exclusive, non-transferable, revocable and non-sub licensable license (“License”) to use the GlobalConnect Developer Portal. This License is for the sole purpose of enabling you to use the functionalities of the GlobalConnect Developer Portal in accordance with these Terms.
You warrant that you have the intellectual property rights to any application or other content you create based on content from the GlobalConnect Developer Portal, and that such content does not violate or infringe the intellectual property rights of any third party. You remain solely responsible for any such content, and GlobalConnect disclaims any and all liability for such content. You will indemnify and hold harmless GlobalConnect from any costs or damages suffered by GlobalConnect as a result of a third party bringing or threatening any claim or action against GlobalConnect on the grounds that such content or any other material provided or used by you in connection with the GlobalConnect Developer Portal infringes the intellectual property rights or other rights of any third party.
You will own the intellectual property in any software or other content that you create based on content from the GlobalConnect Developer Portal. GlobalConnect may request you to provide additional information about how you use content from the GlobalConnect Developer Portal for promotional, commercial, technical, compliance or security reasons. If GlobalConnect requires additional information about your use of content from the GlobalConnect Developer Portal, GlobalConnect may contact you in its discretion to assess whether such usage meets the standards, requirements, specifications and policies as applied by GlobalConnect.
Confidential information
If and insofar you gain knowledge of, or receive confidential information in connection with the GlobalConnect Developer Portal, you must treat such information with strict confidentiality and you may not disclose the same to third parties, both during your registration to the GlobalConnect Developer Portal and after your registration ceases.
Trademarks
The trademarks, service marks and logos (“Marks”) of GlobalConnect on the GlobalConnect Developer Portal are the property of GlobalConnect. You are prohibited from using any of the Marks without the prior written consent of GlobalConnect.Changes
GlobalConnect may at any time change these Terms or any additional terms that apply to specific APIs available through the GlobalConnect Developer Portal. Changes to these Terms will be published in this section of the GlobalConnect Developer Portal, while changes to additional API terms will be published in the relevant API documentation. Changes will become effective no earlier than 10 days after publication. However, changes regarding new functionality of an API, or changes for legal reasons may become effective immediately in accordance with specific API change policy. If you do not agree to changes to these Terms or to changes to the additional terms of a specific API, you must stop your use of the GlobalConnect Developer Portal or such API. You understand and agree that if you use the GlobalConnect Developer Portal or a specific API after the date on which these Terms have changed or the additional terms have changed, your use will be deemed to constitute acceptance of the relevant changes. You can view the most recent version of these Terms in this section on the GlobalConnect Developer Portal.
GlobalConnect has the right to change, modify or expand the functionalities, features and services available on the GlobalConnect Developer Portal, including specific APIs, at any time. Where possible, GlobalConnect will provide prior notice of any such action in accordance with specific change policy, but reserves the right to do so without prior notice. Modifications and changes to the GlobalConnect Developer Portal and its content may affect applications you have created based on content from the GlobalConnect Developer Portal. GlobalConnect will not be liable for any loss or damage resulting therefrom.
Liability
All information on the GlobalConnect Developer Portal, including but not limited to software, source code, object code, applications, graphics, text, documentation, APIs, and links to other sites, is provided "as is" and is subject to change without prior notice. You are aware and accept that GlobalConnect does not commit to, or provide any warranties regarding the quality, security, reliability, availability, or performance of the GlobalConnect Developer Portal. Accordingly, you cannot expect that the content you find in the GlobalConnect Developer Portal is error free, free from security issues, updated, or a suitable source of information for your products or services.
You are aware and accept that you use the GlobalConnect Developer Portal at your own risk and that GlobalConnect is not liable for any direct or indirect damage, which you may suffer due to your use of, respectively your inability to use, the GlobalConnect developer Portal and APIs. You also accept that GlobalConnect’s total liability for damages due to your use of, respectively your inability to use, the GlobalConnect Developer Portal and APIs is limited to 10.000 NOK. By generating data and information to the GlobalConnect Developer Portal and APIs, you accept that you are responsible for your right to publish and distribute such information, including but not limited to a responsibility to ensure that you (i) do not violate any third party’s intellectual property rights, (ii) are entitled to distribute any personal data, (iii) do not distribute information in breach of, or which allude to the breach of, applicable laws and regulations. You undertake to indemnify GlobalConnect, our partners and employees against any claims from third parties pertaining to your use of the API or the API-content in breach of this Agreement.
Feedback
By submitting feedback, comments, ideas and suggestions on the GlobalConnect Developer Portal, you grant a non-exclusive, perpetual, irrevocable, and royalty-free license to any intellectual property rights you may have in such feedback to GlobalConnect to improve the GlobalConnect Developer Portal, including APIs, or any other products or services. Any such feedback is voluntary, and GlobalConnect may consider developing technology that is the same or similar to your feedback.
Miscellaneous
In case any provision of these Terms is or becomes illegal, invalid or unenforceable, the legality, validity, or enforceability of any other provision will not be affected.
These Terms, and any additional terms applicable to a specific API and your use of the GlobalConnect Developer Portal and its contents are governed by the laws of Norway. These Terms apply as of 24th of May 2019.
